Raimondo, leaving in question the capability of the FCC to enforce its net neutrality decision. […] The Sixth Circuit issued its final decision in January 2025, ruling that, in the absence of Chevron the FCC's decision classifying internet service providers as a telecommunication service was inconsistent with the Telecommunications Act of 1996. The Sixth Circuit also ruled that under the statutory reading of Telecommunications Act of 1996, internet service provides should be treated as Title I information services, which would require an act of Congress to change. Advocates of net neutrality declined to appeal to the Supreme Court, saying that the appeal would likely fail with the conservative majority of the current court.

    Donc la restauration de la neutralité du Net initiée sous Biden a échoué. Suite à un revirement de la Cour suprême, il faut un acte du Parlement, la FCC ne peut pas classer les opérateurs comme elle l'entend dans la nomenclature prévue par la loi.
